Export control based on FEFTA Entrance control offoreign researchers and students Research acceptance control(Credit check, etc.) Security Export Controls At Kyushu University, the number of opportunities for international academic exchange and international industry-academia-government collaboration are increasing, and cross-border educational activities and research are actively conducted, such as teaching advanced technologies to international students, sending (or taking out) research materials, equipment and research results to overseas universities and private companies. Although this situation is very desirable from the perspective of internationalization, there is a concern in the international community that such advanced technologies and materials may fall into the hand of terrorists and countries developing weapons of mass destruction. Universities in Japan are strongly required to manage foreign students and to ensure the management of foreign students and the sending (or taking out) of research materials and equipment overseas in accordance with the Foreign Exchange and Foreign Trade Act (Act No. 228 of 1949) and other related laws and regulations (hereinafter referred to as the “FEFTA”). Export control based on FEFTA In order to prevent cargo (or technology) that could lead to the manufacture or development of weapons of mass destruction from passing to states or terrorists that threaten the security of their countries and the international community, many countries, including Japan, have established an international framework, mainly among developed countries, to control such cargo from a security perspective. In Japan, this initiative is implemented in accordance with the Foreign Exchange and Foreign Trade Act, and universities must also comply with the law. In April 2010, the Kyushu University Security Export Control Regulations (日本語のみ) came into effect. These regulations stipulate that the university will conduct unified management when sending (or taking) research materials and equipment overseas and when providing technology to foreign researchers (international students) and others. Researchers are requested to follow the procedures below to apply for export control before sending (or taking) research materials and equipment overseas or providing technology to foreign researchers. Apply for Export Control Entrance Control of foreign researchers and students Entrance control includes the implementation of appropriate management to ensure that the spirit of the Foreign Exchange and Foreign Trade Act is upheld and that the acceptance of foreign researchers and students into the University does not become a threat to the security of Japan or the international community. Entrance control is expected to make the above &＃8220;security control&＃8221; more effective and contribute to domestic and international security and world peace. Apply for Entrance Control of Foreign Researchers and Students Research acceptance control（Credit check, etc.） Kyushu University has established the International Industry-University-Government Collaboration Policy and Guidelines for Acceptance of International Industry-University-Government Collaboration Research, etc. for the purpose of safely and appropriately carrying out international industry-university-government collaboration activities. In accordance with the procedural flow in charge of the Office of Academic Research and Industry-University-Government Collaboration, faculty members and departmental administrators are required to confirm and judge the appropriateness of the organization and content of the collaboration. The Office of Legal Affairs supports the credit checks required of cooperative organizations prior to the acceptance of these international industry-academia-government collaboration activities as well as international activities in general (academic exchange, etc.). Research acceptance control（Credit check, etc.） Q and A Q01留学生の出身機関が外国ユーザーリストに掲載がありました。技術の指導を行おうと思うのですが問題ありませんか？ A九州大学安全保障輸出管理要項第3条（例外の確認）をご確認下さい。当該技術の提供が例外に当たれば学内申請は不要ですが、例外に当たらない場合は学内申請が必要です。 Q02判定の結果“該当”と判定しました。経済産業大臣からの許可証はどれくらいで取得できますか？ A該当した項番によります。数週間から数ヶ月間掛かる場合もありますので、可能な限り早めの申請をお願いします。 Q03判定の結果“非該当”と判定しました。申請書の部局事務への提出は必要ですか？ A申請書の提出は必要です。判定の結果が“非該当”であったとしても、相手先・用途確認が必要となります。最終判定は輸出管理統括責任者が行いますので、“非該当”であっても申請書を作成の上、部局輸出管理部署へ提出してください。 Q04実際には“該当”するものをメーカーの“非該当”の判定を受けて“非該当”として海外に送付してしまった場合、誰の責任になるのでしょうか？ Aメーカーが該非判定を間違えた場合であっても、外為法上は輸出を行った者の責任となります。メーカーからはどうしてそのような判定になったのか、納得いくまで説明を受ける必要があります。 Q05大学に2ヶ月だけですが、雇用されている外国人は居住者になりますか？ A外為法上、雇用された時点で居住者になります。ただし、本国での所属先などを確実に把握し、帰国後に軍事転用等がないことを前提に技術を提供する必要があります。「外国人研究者及び外国人留学生の入口管理手続きに関するガイドライン」に従い、必要な場合は手続きをしていただくようお願いいたします。 Q06外国出張で、リスト規制に該当しないものは自由に持って行けますか？ A一般的に店頭で販売されている貨物（個人用の携帯、ノートパソコン、ドライヤー、時計等）を自己使用のために持ち出し持ち帰る場合は、申請手続なしに海外へ持ち出すことが可能です。ただし海外で他者への提供することを目的とする場合は手続が必要となります。 Q07海外の企業や組織等と共同研究を行う場合は、研究をはじめる前に輸出管理手続が求められるのですか？ A国際的な共同研究にかかる輸出管理手続は、研究の実施中に資機材の提供等が必要になる時点で行ってください。共同研究そのものについても、開始前に相手先企業や組織等については十分把握し安全性を確認する必要があります。国際産学官連携研究等の受入に関する取扱いについてで定める手続きをお願いします。 Q08特許情報を提供する場合、許可を取らなくてもいいのでしょうか？ A公開特許情報は「公知の技術」にあたり、輸出管理手続上の許可は不要です。 Q09学会用の原稿は許可不要ということですが、どんな機微なものでもよいのでしょうか？ A学会等で公表することを前提に作成されたものは、規制対象とはなりません。しかしなから、大量破壊兵器等の開発等を助長する可能性のある技術については、公開の適否について慎重に判断するようにしてください。不明な場合は法務統括室へご相談ください。 Q10教育（講義）は技術の提供に当たりますか？ Aいわゆる市販されている教科書を使った講義は公知の技術の提供にあたり規制対象ではありません。しかしながら、研究室で保有し外に発表していないノウハウ、データやプログラムを用いて外国人大学院生や研究生等に技術を提供する場合は、内容によっては許可が必要になる場合があります。詳しくは、輸出管理統括責任者が別に定める研究・教育活動における技術の提供（要項第３条第２項２号）【学内限定】をご確認下さい。 Q11申請書類作成の証憑（エビデンス）として用いたEmailとは、どのような内容のものを指すのでしょうか？ A貨物の輸出にかかる申請書の場合は、当該貨物の輸出が確実に行われることが示されたEmail等をエビデンスとして提出してください。技術の情報をEmailで提供する場合は、当該Emailをそのままエビデンスとして提出していただくことが適当です。 Kyushu University Integrated Legal Office Shiiki hall 2F 744 Motooka Nishi-ku Fukuoka 819-0395, Japan Phone: +81-92-802-2019 / E-mail: legal(*)qilo.kyushu-u.ac.jp Change (*) into @ ©2018 KYUSHU UNIVERSITY Integrated Legal Office All Rights Reserved.
